Federal officials are investigating Jack Smith, who was the special counsel in charge of looking into Donald Trump before Trump won reelection. The Office of Special Counsel, which is a separate government agency, confirmed the investigation after news reports came out. Jack Smith was chosen to investigate Trump by Attorney General Merrick Garland back in November 2022.
Supporters of Trump, like Senator Tom Cotton, claim—without proof—that Smith broke the Hatch Act. This law says some government officials can’t do political activities. Smith had started two court cases against Trump in the months before the November 2024 election.
After Trump won the election, Smith dropped both cases before they went to trial. This is because, as a rule, the Justice Department doesn’t prosecute sitting presidents. After dropping the cases, Smith resigned from his job as special counsel.
Senator Cotton asked the Office of Special Counsel to look into Smith, saying he tried to help President Joe Biden and Vice President Kamala Harris, who are both Democrats. Biden didn’t run for reelection after not doing well in a debate against Trump, so he asked Harris to take his place on the ticket.
Trump won the election. The White House has not commented on the investigation. The New York Post was the first to share news about the investigation.
