Dr. David Morens, a former senior adviser to Dr. Anthony Fauci at the National Institute of Allergy and Infectious Diseases (NIAID), pleaded guilty on Tuesday to conspiring to conceal federal records related to COVID-19 research grants and pandemic origins.

Guilty Plea and Charges

Morens, 78, entered his plea in federal court in Greenbelt, Maryland, admitting to one count of conspiracy to commit offenses and defraud the United States. Under a plea agreement with federal prosecutors, four additional charges were dropped. He faces up to five years in prison and a fine of up to $250,000, with sentencing scheduled for November.

Scheme to Evade Public Records Laws

According to court documents and the Justice Department, Morens conspired with two co-conspirators between April 2020 and June 2023 to obstruct Freedom of Information Act (FOIA) and Federal Records Act compliance. He directed communications about COVID-19 research, including a controversial bat coronavirus grant, through his personal Gmail account rather than official NIH email to avoid public disclosure.

Morens also shared nonpublic NIH information and “back-channel” communications to an unidentified senior NIAID official, believed to be Dr. Fauci, who is not accused of wrongdoing.

Background and Context

Morens served as a senior adviser at NIAID’s Office of the Director from 2006 to 2022, working closely under Fauci during the pandemic. He was indicted in April on five counts before negotiating the plea deal. The case centers on efforts to hide discussions about the termination and potential restoration of NIH funding for coronavirus research amid scrutiny over the pandemic’s origins.
