Federal Judge to Weigh Trump’s Birthright Citizenship Rule

A federal judge will decide Friday whether to keep blocking President Donald Trump’s order limiting birthright citizenship. Last month, the Supreme Court made it harder for lower courts to stop White House policies, but 18 states and Washington, D.C., are fighting to keep the block in place.

In February, Judge Leo Sorokin stopped Trump’s order, which denied citizenship to babies born in the U.S. if their parents weren’t citizens or permanent residents. Now, after the Supreme Court’s June 27 ruling, Sorokin must reconsider his decision.

The Supreme Court’s 6-3 decision, written by Justice Amy Coney Barrett, didn’t rule on Trump’s policy. Instead, it warned judges against issuing nationwide blocks on federal policies. The states argue Trump’s order is unlawful and want Sorokin to keep his injunction.

The hearing is set for 10 a.m. in Boston. The outcome could affect thousands of families. Birthright citizenship, granted by the 14th Amendment, has long been a legal right for anyone born in the U.S.
