A U.S. trade court has raised doubts over the legality of sweeping 10% global tariffs imposed by Donald Trump, intensifying an ongoing legal battle over his trade policy. Judges at the United States Court of International Trade questioned whether a persistent trade deficit qualifies as an economic emergency under the law used to justify the tariffs.
The measures, introduced in February, are being challenged by more than 20 states and several businesses, who argue the policy misuses powers meant for short-term crises. The case follows a prior Supreme Court setback for Trump’s earlier tariffs, leaving the future of the new duties uncertain as the court deliberates its ruling.
