President Donald Trump is facing a federal lawsuit over a new Truth Social service that charges subscribers up to $100,000 monthly for faster access to his posts, including official government announcements.

The Lawsuit

The Intercept and the Freedom of the Press Foundation filed the suit on August 12 in Manhattan federal court, calling the arrangement “extraordinary, corrupt, and unconstitutional.” The plaintiffs argue the service violates the First Amendment by denying equal public access to presidential statements and the Fifth Amendment by imposing unreasonable financial conditions for government information.

Truth API Service

Called Truth API, the service launched August 1 and delivers posts from Truth Social’s top accounts—including Trump, the White House, and Vice President JD Vance—within milliseconds to paying customers. Trump Media interim CEO Kevin McGurn disclosed during an earnings call that more than 10 customers, primarily high-frequency trading firms, have subscribed at rates between $60,000 and $100,000 per month.

Constitutional Concerns

The lawsuit contends that Trump profits financially by selling advance access to market-moving government information through his personally owned platform, where he holds approximately 41% of Trump Media & Technology Group. Plaintiffs are seeking a court order to block Trump and White House officials from posting official government information exclusively on Truth Social while the paid preferential access service operates.

Trump Media has dismissed the lawsuit as an effort by “left-wing activists” to silence the president.
